Freedom of Information and Data Protection

The Freedom of Information Act allows individuals to request information held by public authorities, subject to certain exemptions. It also requires authorities to have a Publication Scheme to specify the classes of information the public authority already publishes or intends to publish.

People who want to access information about themselves are advised not to make a Freedom of Information Act request but to apply under Data Protection Legislation which provides individuals with a right to ask for a copy of personal data held about themselves unless certain exemptions apply. This is known as ‘subject access’.
